Breeze Physique Tracker Terms of Use

These terms cover the Breeze Physique Tracker mobile app. The Coaching Services Agreement covers coaching bought through this website and does not apply to the app. Privacy is covered separately by the app privacy policy.

1. Agreement

By downloading or using Breeze Physique Tracker you agree to these terms. If you do not agree, do not use the app.

The app is published by Breeze Lifting Entertainment LLC, a Florida limited liability company doing business as Breeze Lifting ("we", "us").

If you obtained the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and where it conflicts with these terms on a matter it covers, Apple's agreement governs.

2. What the app does

Breeze Physique Tracker records progress photos, body measurements, notes, goals and streaks so you can see change over time. It can assemble your photos into a timelapse video and compare two days side by side.

It is a personal tracking tool. It is not a coaching service, and buying a subscription does not enrol you in coaching.

3. Your data stays on your device

There is no account and no login. Your photos, measurements and notes are stored only on your device. They are never uploaded to us, we operate no server for this app, and we cannot see them.

That matters more than usual here, because this is an app you point a camera at yourself with. The full detail — including the two third-party services that do communicate over the internet, for advertising and for purchases — is in the app privacy policy.

Because we hold no copy, we cannot recover your data. If you delete the app or erase its data, it is gone. Export anything you want to keep first, using Settings → Data.

4. The free tier

The app is free to use. The free tier is supported by advertising and limits some features rather than withholding the app.

On the free tier:

Three timelapse exports per month.
Exports render at 720 pixels on the long edge, carry a "Breeze Physique Tracker" watermark, and finish with a short end card.
The 9:16 "Reel" shape is available. The 4:5 "Feed" and 1:1 "Square" shapes are Pro.
Banner ads appear in the app.
You may optionally watch a rewarded video ad to unlock one additional export. That unlock is a one-off and is not stored permanently.

Nobody has to watch an ad. Declining simply means no extra export.

5. Breeze Physique Tracker Pro

Pro is an auto-renewing subscription, offered on a monthly and an annual plan. It removes ads and unlocks timelapse export, Before / After compare, the full set of export shapes, and full-resolution 1080-pixel output with no watermark.

Price. The price of each plan, in your local currency, is shown in the app on the subscription screen and on the store listing before you buy. No price is stated here, because prices are set per storefront and can change; the figure shown to you at the moment of purchase is the one that applies.

Billing is handled by the app store, not by us. Apple or Google takes payment through the account you already use with them. We never see or handle your payment card, billing address, or store account credentials.

Renewal. A subscription renews automatically at the end of each period unless cancelled at least 24 hours before it ends. Your account is charged for renewal within 24 hours of the period ending.

Cancelling. Cancel through the store, not in the app — we cannot cancel a subscription on your behalf:

iPhone or iPad: Settings → your name → Subscriptions
Android: Google Play → your profile → Payments and subscriptions → Subscriptions

Cancelling stops the next renewal. You keep Pro until the end of the period you have already paid for.

Free trials. Where an introductory or free-trial offer is available on a plan, its length and terms are shown on the subscription screen before you confirm. Cancel during a free trial and you are not charged. Any unused part of a free trial is forfeited if you subscribe before it ends.

Refunds are handled by the store under its own policy, not by us. On Apple, use reportaproblem.apple.com. On Google, use the Play Store's refund process.

6. Promotional trial codes

We sometimes issue a promotional code that unlocks Pro for a fixed number of days — currently 14 days.

A code can be redeemed once per device.
The trial ends automatically when the days run out. It does not convert into a paid subscription, and no payment details are taken.
Codes have no cash value, cannot be exchanged, and may be withdrawn or expired at any time.

7. Acceptable use

Do not:

Reverse engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law.
Interfere with advertising, purchase verification, or the limits described above, or use the app with tools intended to do so.
Use the app to store or produce material that is unlawful, or images of any person who has not agreed to be photographed.
Resell, sublicense, or redistribute the app.

The app is for your own personal, non-commercial use.

8. Not medical or professional advice

Breeze Physique Tracker records what you tell it. It does not assess, advise, diagnose, or treat.

Progress photos, measurements, weights, streaks and any chart the app draws from them are a record of your own inputs. They are not medical advice, not a diagnosis, and not a substitute for a physician, registered dietitian, physiotherapist, or mental health professional.

Consult a qualified professional before starting or changing a training or nutrition programme, and for any health concern. If tracking your measurements or photographing yourself is affecting your wellbeing, stop using the app and speak to someone qualified.

The app is not intended for anyone under 18.

9. Intellectual property

The app, its design, and its content are owned by Breeze Lifting Entertainment LLC and are protected by copyright and other laws. You receive a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for as long as you comply with these terms.

Your photos and measurements remain yours. We claim no ownership of anything you record, and we could not use it if we wanted to — it never reaches us.

10. Availability and changes to the app

We may change, suspend, or discontinue any part of the app, including features of the free tier or of Pro. If we discontinue a feature that Pro exists to provide while you are within a paid period, contact us.

The app depends on your device's operating system and on the app store. We do not guarantee it will remain compatible with future versions of either.

11. Disclaimer of warranties

To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted or error-free, or that any defect will be corrected.

Nothing here removes rights you have under mandatory consumer protection law in your country, which apply regardless of what this document says.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the app.

Our total liability will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or ten US dollars.

Because your data is stored only on your device, you are responsible for backing it up. Use Settings → Data to export your photos and measurements.

13. Termination

You may stop using the app at any time by deleting it. Deleting the app does not cancel a subscription — cancel through the store, as described in section 5.

We may suspend or end your licence if you materially breach these terms.

14. Changes to these terms

We may update these terms as the app changes. When we do, we revise the effective date above and post the new version at this address. Material changes will be noted in the app or in the store release notes. Continuing to use the app after an update means you accept the revised terms.

15. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

If you use the app as a consumer outside the United States, this does not deprive you of the protection of mandatory provisions of the law of the country where you live, and you may be able to bring proceedings there.
